YouPlay September 2008 – August 2009 Promotion
TERMS AND CONDITIONS

1. Information on how to enter and win prizes forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to Australian, New Zealand and United Kingdom residents aged 18 years or over who are Premium Members (registered subscribers) of youplay.com (“Eligible Members”). Entry is not open to guests (non-registered players) or free members* (registered non-subscribers).
*Except in the case of the Lovatts Lucky Member Draw.
3. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. Daily and/or Weekly Draw:
Daily - $50
Weekly – $100
To enter, Eligible Members must:

(a) login to the youplay.com website;
(b) play and successfully complete any daily competition game on the website (including correctly answering questions and/or completing the first round/level of a game, as instructed on the website); and
(c) upon successful completion of the game, choose whether to enter the relevant Daily Draw or Weekly Draw from the available options as prompted on-screen; during the Promotional Period.
5. There are a number of Daily Draws and Weekly Draws to be conducted under various promotions covered under these Terms and Conditions.

Eligible Members receive an entry into two (2) draws (the Daily Draw and the Weekly Draw) the first time a daily competition game is completed per day. Competition games that have multiple rounds/levels will only be eligible for entry into the Weekly Draw based on completion of the first round/level, and not any subsequent rounds/levels. Subsequent rounds of the initial competition game will allow multiple entries into the Daily Draw which is unlimited. Not all games allow entry into Daily Draws and/or Weekly Draws.
6. There is no limit to the number of entries each Eligible Member may have in a Daily Draw. An Eligible Member may play the same competition game repeatedly to receive multiple entries in a Daily Draw, but each Eligible Member may only receive ONE (1) entry into a Weekly Draw for playing the same game.
7. DAILY DRAWS: Entries for each Daily Draw open at 12.00 am and close 11.59 pm each day of the promotional period. Each Daily Draw will be conducted at 12:00 pm the following day (except that draw for Saturdays, Sundays and public holidays in NSW will be conducted on the following business day).
8. WEEKLY DRAWS: Entries for each Weekly Draw open at 12:00 am each Wednesday and close 11.59 pm on the following Tuesday during the Promotional Period. Each Weekly Draw will be conducted at 12:00 pm the following Wednesday (except that draw for public holidays in NSW will be conducted on the following business day).
9. Monthly Draw - $250
To enter, Eligible Members must:

(a) login to the youplay.com website;
(b) play and successfully complete any game on the website (including correctly answering questions and/or or completing the first round/level of a game, as instructed on the website); and
(c) upon successful completion of the game, choose whether to enter the Monthly Draw; during the Promotional Period.
10. Eligible Members may receive an entry into only ONE (1) Monthly Draw for completion of each game. Games that have multiples rounds/levels will only be eligible for entry based on completion of the first round/level, and not any subsequent rounds/levels.
11. Each Eligible Member may only receive ONE (1) entry into a Monthly Draw per day for playing the same game.
12. MONTHLY DRAWS: Entries for each Monthly Draw open at 12:00am on the 1st of each month and close 11:59pm on the last date of the same month. Each Monthly Draw will be conducted at 10:00am on the 1st day of the following month. There will be a total of 12 x Monthly Draws. The first valid entry draw in each Monthly Draw will win $250 and the next three winners will each win a YouPlay Prize Pack valued at $100. Contents will vary, but will include an array of magazines, YouPlay premium membership and Lovatts merchandise – e.g. Magazine light, coffee mug, key-ring, bumper sticker, credit card size magnifying glass, key-ring).
13. Lovatts Lucky Member Prize:
Daily - $30 or $60
14. To claim the prize, Eligible Members must:
(a) login to www.youplay.com (“Website”);
(b) activate the ‘Lovatts Lucky Member’ link from the ‘Jessie’s Welcome’ component of the YouPlay home page to reveal the winning User ID;
(c) identify the winning User ID as their own; and
(d) contact us by sending an email to ‘McTroy’ via the YouPlay email account that corresponds to the winning User ID within the 7 day promotional period.
(e) If the winner holds a valid Premium Membership at the time of the draw, the prize money is doubled from $50.00 to $100.
(f) if the winner is not a Premium Member but elects to purchase a valid annual subscription within the 24 hour promotional period, the prize money is doubled.
15. Eligible Members receive one automatic entry into the Lovatts Lucky Member Draw for the 24 hour promotional period.
16. The winning User ID will be drawn using a ‘Random Number Generator’ approved by the NSW Department of Gaming & Racing in March 2008. This User ID will be displayed on the website for the 24 hour promotional period.
17. If the winner is not a Premium Member at the time of the draw, but elects to subscribe during the promotional period to double the prize money, the following conditions apply:
(a) the winning member must purchase a subscription using the annual payment plan;
(b) the purchased annual subscription is non-refundable.
18. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process (including but not limited to tampering by way of use of techniques designed to avoid the payment of membership costs). Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
19. Incomplete, indecipherable or illegible entries will be deemed invalid.
20. Promotional period commences 0.01 am on 1st September 2008 and ends 11.59 pm on 31st August 2009 (“Promotional Period”). All times are AEST or AEDST, whichever is applicable in NSW.
21. All draws will be conducted at YouPlay Offices, Gosford, NSW. Entries in each draw will NOT be entered into any subsequent draws.
22. Winners will be notified by email and will also have their names published on the YouPlay website.
23. The Promoter’s decision is final and no correspondence will be entered into.
24. All prize values are in $AUD. Prizes will be awarded in the form of a cheque made payable to the winner. Prizes are not transferable or exchangeable.
25. Total prize pool value is $57,850.
26. A draw for any unclaimed prizes may take place no sooner than three months from the original draw date, subject to any directions from a regulatory authority.
27. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
28. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
29. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
30. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
31. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winner or entrant; or (e) use of any prize.
32. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
